NOWADAYS THEATRE MEMBERSHIP TERMS AND CONDITIONS
These are the terms and conditions which apply to your NOWADAYS THEATRE Membership (‘these Conditions’). By purchasing or renewing a Membership with the NOWADAYS THEATRE Company, you are agreeing to be bound by these Condition
DEFINITIONS
‘NOWADAYS THEATRE’ and ’NTC’ (and ‘we’, ‘our’, ‘ours’ and ‘us’) refers to the NOWADAYS THEATRE Company, which is a Toronto-based federal non-profit company registered in Canada with corporation number 974015-5.
‘Membership’ means the contract between us in accepting your offer to purchase specific Benefits from NTC, ‘Gift Membership’ means the contract between us in accepting your offer to purchase specific Benefits from NTC for a designated person,
‘Membership Level’ means the specific level of membership you have purchased.
‘NTC Membership Card’ means the card which is issued to you by the NOWADAYS THEATRE Company following an application in accordance with these Conditions.
‘NTC Membership Card number’ means the account number issued to you when you purchased your NTC Membership Card.
‘Benefits’ means those products, services and discounts at NTC events and workshops which are from time to time notified on our website, newsletters or mailings, as available to holders of a valid and current NTC Membership Card.
‘Credit’ means funds retained by NTC on your account for you to use for future purchases.
‘Initial Fee’ is the fee paid when you purchase your NTC Membership Card. ‘Renewal Fee’ means the sum payable by you as set by NTC at the end of the first 12 month validity period and for any subsequent 12 month periods thereafter.
‘Personal Information’ refers to all personal data relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier
‘You’ means you or anybody who in our reasonable opinion is acting with your authority or permission
‘Our terms and conditions of sale’ means those that apply to our customers purchasing tickets and attending any NTC events as published from time to time.
‘Validity Period’ refers to a 12 month period from the date of the initial purchase or renewal of your NTC Membership Card and means the period during which your NTC Membership Card is valid in accordance with these Conditions.
‘Working Day’ means Monday to Friday, excluding any Public or Bank Holidays.
‘Our website’ means https://www.nowadaystheatre.org/
1. Membership Benefits
1.1 A valid NTC Membership Card will entitle you to the Benefits, but all Membership Benefits are subject to availability and to these Conditions and NOWADAYS THEATRE reserves the right to amend or withdraw any Benefit(s) offered to you at our discretion.
1.2 Membership does not guarantee access to tickets in the event that tickets are sold out. Any purchase of tickets by Members and/or use of Membership Benefits is subject to these Conditions in full. We reserve the right to rescind a Membership without refund where any ticket(s) or Membership Benefit(s) have been obtained, transferred or resold in breach of our Terms and Conditions of Sale. 1.3 Fee free ticket exchange is offered subject to availability of equivalent value tickets on the dates requested. We reserve the right not to offer an exchange if there is no reasonable prospect of being able to re-sell the tickets which are offered for exchange. No fee will be charged for making an exchange. If tickets of a higher value are requested or if fees or costs (including postage) are applicable to the requested tickets we may require such fees and costs to be paid by you before making an exchange.
1.4 All Membership Benefits must be redeemed during the Membership period (see 2.6) and cannot be applied following the expiration of the Membership retrospectively unless specifically granted by NOWADAYS THEATRE at our discretion.
2. Purchasing NTC Membership Card
2.1 To purchase an NTC Membership Card you must be at least 18 years of age.

2.3 The NOWADAYS THEATRE Company reserves the right to refuse any application for an NTC Membership Card.
2.4. Payment for Memberships may be made by Credit Card (American Express, Mastercard or Visa), Debit/Bank Card, Cheque, Bank Transfer, or Direct Debit.
2.5 When your application for an NTC Membership Card has been accepted you will be issued with an NTC Membership Card and an NTC Membership Card number. Neither an NTC Membership Card nor an NTC Membership Card number will be issued until NTC has received full payment.
2.6 All Memberships are valid for 12 months from the date of purchase (in the case of a Gift Membership, the date of delivery) or renewal, subject to any longer period as specifically granted by NOWADAYS THEATRE at our discretion.
2.7 Subject to these Conditions, the NTC Membership Card will be valid for the Validity Period, commencing on the date that you purchased your NTC Membership Card.
3. Using Your NTC Membership Card
3.1 Your Membership is for personal use only, is non-transferable to any third parties. A Membership cannot be resold or exchanged for cash. Only the named holder on the NTC Membership Card will be entitled to use the NTC Membership Card and to receive Benefits.
3.2 NTC reserves the right to refuse to supply you with Membership Card and can terminate your NTC Membership Card and/or demand the return of your NTC Membership Card and/or cancel it at any time if, in its reasonable opinion, you are in breach of these Conditions.
3.3 Your NTC Membership Card number must be quoted at all times when booking tickets.
3.4 Any Benefits and tickets obtained in breach of these Conditions will be made null and void and NTC may refuse to admit the ticket holders to its venues.
3.5 The Initial Fee and any Renewal Fee are non refundable in the event that an NTC Membership Card is terminated as permitted by these Conditions.
4. Renewal
4.1 At least one month before the expiry of the first 12 months of the Validity Period, NTC will offer you the opportunity to renew your NTC Membership Card for a further twelve-month period. Any renewals will be subject to payment of the then current Renewal Fee.
4.2 If the price of Membership has increased we will give you at least 10 working days’ notice of the change. You understand that, once granted, continuous direct debit authority shall remain in force until you instruct a cancellation in writing by sending an email to info@nowadaystheatre.org. We reserve the right to terminate your Membership if payment cannot be taken as instructed.
5. Cancellation
5.1 The membership fee is non-refundable. If after submitting for membership, you are not able to use the benefit for any circumstances, subject to sending an email to info@nowadaystheatre.org whitin 10 days after submitting, your membership fee can be considered as a credit for you for a year from the submitting time.
5.2 If you want to postpone benefits of your NTC Membership Card following purchase, you explicitly acknowledge that the right to postpone within a 10 day period, outlined in clause 5.1 above, is automatically waived and does not apply to Your contract with Us. You acknowledge that by using Your NTC Membership Card within the 10 day period You are expressly requesting for the Benefits to commence.
6. Cancellation by NTC
6.1 NOWADAYS THEATRE may cancel your NTC Membership Card if you provide any false information at the time of purchase, you misuse your card in anyway or there is any irregularity in the payment of any fees for your NTC Membership Card or tickets.
6.2 If NTC do cancel your NTC Membership Card as permitted by these Conditions you will not be entitled to any refund of your Initial Fee or any Renewal Fee.
7. Data Protection
7.1 You must ensure that your personal information is accurate and complete. It is your responsibility to inform NOWADAYS THEATRE of any changes to your personal information. If you are purchasing a Gift Membership, it is your responsibility to ensure that the personal information of the recipient is accurate and complete.
7.2 We will use your personal information to provide you with all information, benefits and services specific in your Membership. By purchasing a Membership, you consent to NOWADAYS THEATRE using your personal information in order to administer the benefits and privileges you have purchased from us and provide you with all information connected with the supply of your NTC Membership Card including; ticket offers, Benefits, renewals, brochures and newsletters, events, offers, changes to the NTC Membership Card scheme.
7.3 You have the right to access or alter to the information we hold about you so long as it does not unreasonably prevent, restrict or inhibit the delivery of the Benefits you have purchased from us.
7.4 When you become a member of NOWADAYS THEATRE, you are agreeing to the terms of consent set out in our Privacy Policy. Our Privacy Policy can be viewed in full on our website here. 8. General
8.1 NOWADAYS THEATRE reserves the right to change the price of a Membership at any time. We will notify you if there is a change in the price of a Membership.
8.2 If any part of these Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.
8.3 These Conditions (as amended from time to time) contain the entire agreement and understanding between you and us in respect of all matters which are referred to herein and supersede any prior written or oral agreement between us relating to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Conditions. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions. However, nothing in these Conditions purport to exclude liability for any fraudulent statement or act.
8.4 These Conditions will be exclusively governed by and construed in accordance with the laws of Canada whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
